When a Virginia business receives a wage garnishment for an employee, the employer is legally required to withhold a portion of that employee’s paycheck and send it to the court. Withholding begins as soon as the summons is served and continues until the return date listed on the order. Employers must calculate the proper amount each pay period (usually up to 25% of disposable earnings), follow the payment instructions on the summons, and file the required Garnishee’s Answer form with the court. Ignoring a garnishment can result in the employer being held liable for the full debt, but following the step-by-step process makes compliance straightforward for any small business.
